Pricing Terms

eEvidence Licensing Model

eEvidence is based on a freemium business model, meaning it is provided free of charge, but a premium is charged for advanced features. The word "freemium" is a portmanteau combining the two aspects of the business model: "free" and "premium".

Premium Licenses

eEvidence offers you the option to upgrade your free account, at any time and at an annual or monthly flat-rate fee, and benefit from eEvidence's advanced features. When doing so, your account will be converted to a Premium License and will not be subject to some of the restrictions placed on Free Licenses as described below.

eEvidence accepts credit and debit cards, PayPal and bank transfers as payment methods. If you wish to pay by Credit or Debit Card, you may do so through PayPal. We will never keep your credit or debit card information nor your PayPal account's details.

Premium Licenses are enabled once your payment has been received.

Disclaimer

It is your responsibility to provide payment for your Premium License fees as required. If any fee is not paid in a timely manner, eEvidence reserves the right to suspend, cancel or remove your Premium License, to assign a Free License to all the users sharing the license (which is subject to the restrictions described below) and to delete the files we may have been storing for you up until then. We decline any responsibility regarding the loss of data resulting from your inability to provide payment as required.

Upgrading your Premium License

Premium Licenses may be limited by the number of emails you are allowed to register during the license's annual subscription. If you fall short on choosing the right license, don't worry. Once you reach your license's limit, we will send you a license upgrade notice to the email address you have provided for your account's administrative contact, including a link to upgrade your license. We may keep sending such notices until you effectively upgrade your license. Starting on the date you receive the first upgrade notice, you will have 15 days to make your payment. During this time, you are allowed to continue using the service normally. In case you decide not to upgrade, your Premium License will be suspended after 15 days from the first upgrade notice and you will not be allowed to register any more emails any longer. Please provide payment as soon as possible in order to avoid license suspension.

Should you elect to upgrade your Premium License to a more featured license, the commencement date for your next renewal period will be kept unchanged. If your Premium License is being billed annually, you will be charged the new license annual fee fully minus a refund for the full license annual fee we charged you from your previous license. If your Premium License is being billed monthly, we will recalculate your subscription monthly fee accordingly. In other words, we understand you are upgrading your license because you fall short on choosing the right license in the first place.

Upon an upgrade notice, it is up to you whether to upgrade to a more featured license or to renew your current license before its expiration date. If you decide to renew your license, instead of upgrading it to a more featured one, the commencement date for your next renewal period will be reset and you will be charged the new license fee fully. No refunds will apply if you choose to renew your license before the expiration date.

Renewing your Premium License

If you decided to pay for your Premium License annually, you will need to renew your subscription every year. Please do not worry about your license's expiration date: we will let it expire before we ask you to renew, allowing you 30 days to make your payment. On your license's expiration date, we will send you a license renewal notice to the email address you have provided for your account's administrative contact, including a link to renew your license. We may keep sending such notices until you effectively renew your license. Starting on the date you receive the first renewal notice, you will have 30 days to make your payment. During this time, you are allowed to continue using the service normally. Please provide payment as soon as possible. When doing so, we will allow you to switch your annual billing plan to a monthly billing plan.

IT IS NOT ALLOWED TO RENEW TO A LESS FEATURED LICENSE. Premium Licenses include the custody of your evidence files, at no additional cost. The custody of your data will increase continuously as you use the service, for what the fees for Premium Licenses have been designed to support the cost of keeping your files safe. That in the future you decrease how often you use the service dos not mean that the volume of the data that we keep in custody for you diminishes, neither will its associated cost.

If your Premium License is billed monthly, we will continue to bill your account every month, as long as you do not delete your account. Please make sure you keep your credit card, debit card or PayPal account up to date. If we cannot charge your subscription fee from the credit card, the debit card or the PayPal account you provided for making your payments, we reserve our right to cancel your Premium License as explained before.

When renewing your Premium License, the number of emails you have registered during the new annual subscription term will be set to zero. However, if on the previous annual subscription term you had exceeded the maximum number of emails that your Premium License allows you to register in a year, or if when you effectively renew your license your Premium License is found suspended due to your inability to correct a service overage, the overage will account for the new annual subscription term. You therefore accept that when renewing your license, the number of available emails to be registered in a year within your license may be less than what your license actually permits.

E+ Unlimited overquota fees

The E+ Unlimited Premium License fee covers a limited number of emails you can register in a year without additional cost. If you register more, additional charges will apply. We will charge you for the eventual overquota by sending you an account statement to the email address you have provided for your account's administrative contact, including a link to make your payment. We may keep sending such notices until you effectively make your payment. Starting on the date you receive the first overquota notice, you will have 30 days to make your payment. During this time, you are allowed to continue using the service normally. In case we don't receive your payment on time, your Premium License will be suspended after 30 days from the first overquota notice and you will not be allowed to register any more emails any longer. Please provide payment as soon as possible in order to avoid license suspension.

Billing

You acknowledge that the flat-rate applied each year may vary for reasons that include, differing amounts due to promotional offers, differing amounts due to changes in your account, or changes in the amount of applicable sales tax, and you accept that your renewal flat-rate may vary from your prior payment. All fees and payments are nonrefundable and there are no refunds or credits for partially used periods.

eEvidence may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. It is your responsibility to keep your contact information current and updated.

Valid invoices will be sent to you as soon as we can confirm you have made your payments, not before. Valid invoices will be sent to you via email to the email address you have provided for your account's billing contact.

Canceling Your Account

Your eEvidence Premium License will continue in effect unless and until you cancel your Premium License or we terminate it due to non-payment when your annual renewal is due. Your failure to cancel your Premium License before it renews each year does not oblige you to actually renew your account's Premium License nor to pay us for it. In such cases, eEvidence will consider your account unpaid and proceed accordingly, as explained before.

eEvidence Premium Licenses are prepaid and are non-refundable. EEVIDENCE DOES NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL YEARS. You may cancel your eEvidence Premium License at anytime, and cancellation will be effective immediately. If you wish to cancel your Premium License you may do so via your "Account" page. Should you elect to cancel your Premium License, please note that you will not be issued a refund for the previous annual fee.

By signing up for an eEvidence Premium License, you hereby agree to these payment terms and conditions.

Free Licenses

eEvidence may allow you to use the service for free up to a limited number of registered emails a year. eEvidence reserves the right to terminate Free Licenses at any time, with or without notice. You are not obliged to use the Service on a regular basis; eEvidence will not delete nor suspend your account based on none use.

As for the service's basics, Free Licenses are fully featured, but are intended for individual use only and may allow a limited number of free certification a year, counting from the date you registered for the service. eEvidence will stop certifying your emails and files once you have reached your annual certification limit. In such cases, we will enable your annual limit back once 1 (one) year has elapsed since you registered for the service or since the previous account renewal took place.

eEvidence's referral program allows you to increase your annual Certification limit by 1 (one) certification unit for every user referred by you that registers for the service. These earnings are forever and you will keep whatever limit you reach on every year's renewal.

Free Licenses are for individual use only. This means you will not be able to associate multiple email addresses or other users to the same license. Being that Free Licenses do not include the option to store a copy of the emails and digital files you have submitted to eEvidence, this limitation is not of a major importance.

License limitation

The use of your eEvidence account is personal and not transferable. Even so, you can share an eEvidence Premium license with as many users as your license allows you to, inviting them to join your group. There are, however, some sharing limitations that you must carefully observe:

  • It is prohibited to sell the shared use of an eEvidence Premium license. You can invite others to join and use your license registering their own account, but you are not allowed to make any economical profit, directly or indirectly, when doing so.
  • It is prohibited to set up an eEvidence Premium license as part of any distributed solution, software, service or process, when this integration means that a user of this distributed solution, software, service or process will be using the service from within your eEvidence Premium license. If you want to integrate eEvidence in a distributed solution, software, service or process, each user of this distributed solution, software, service or process will require to register for an eEvidence Premium license in order to use eEvidence.

 

Failure to comply with this limitation, will result in us immediately and unilaterally suspending, without previous notice, the infringing eEvidence license, as well as deleting all user accounts associated with it, including the deletion of any files and data, related to said users, that may have been stored in and by eEvidence.
